FAITH ANGLER NETWORK PARTICIPANT RELEASE OF LIABILITY – READ BEFORE SIGNING
In consideration for permission to voluntarily participate in tournaments, events, programs, and related activities conducted by Faith Angler Network, (doing business as FAN), I acknowledge, appreciate, and agree that:
The risk of injury, disability, death, loss or damage to my person or property from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; AND, I have been advised by FAN, and have had the opportunity to seek legal counsel with respect to the legal effect of this document; AND, I KNOWINGLY AND FREELY ASSUME ALL RISKS REFERRED TO ABOVE, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF FAITH ANGLER NETWORK, THEIR OFFICERS, OFFICIALS, DIRECTORS, SHAREHOLDERS, AGENTS, AND/OR EMPLOYEES, OTHER PARTICIPANTS, AND SPONSORING AGENCIES, SPONSORS, ADVERTISERS, THEIR PARENT AND AFFILAITE COMPANIES AND, IF APPLICABLE, OWNERS AND LESSORS OF PREMISES AND PROPERTY USED TO CONDUCT THE EVENT (“RELEASEES”) OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR RISKS ARISING FROM MY PARTICIPATION; AND, I willingly agree to comply with the terms and conditions, code of conduct, policies and procedures for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the immediate attention of the nearest official; AND I, FOR MYSELF AND ON BEHALF OF MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS RELEASEES, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHICH I SUFFER OR WHICH I AM FOUND TO HAVE CAUSED IN WHOLE OR IN PART BY MY NEGLIGENCE OR INTENTIONAL MISCONDUCT, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES, OR OTHERWISE, TO THE FULLEST EXTENT OF THE LAW.
I agree to submit, by digital signature, to a polygraph or voice stress analysis examination. Hereinafter known as a truth verification test, and abide by its conclusion. Truth verification test(s) will be used at FAN’s sole discretion, and administered by FAN or its agents. I understand that failure to pass the examination as determined by FAN will result in disqualification. I certify that the number shown on these forms is my correct taxpayer identification number.
Having fully acquainted myself with the tournament rules, code of Conduct, ALL FAN Policies and Procedures as outlined in the FAN Rules, Code of Conduct and Policy and Procedure, I have completed this application and submit it for my entry. In signing this application, and by my presence at the event, I hereby agree to be bound by and comply with all tournament rules, participant release of liability and safety regulations. I expressly assume all risks associated with the tournament. If I am using a boat during the official practice or the event, I certify that I now have, or will obtain prior to the event, property damage watercraft liability insurance having a reasonable limit. Said insurance must cover injury and/or damage incurred in connection with the event. Upon request, I will provide satisfactory evidence of said insurance. I hereby wave my rights of privacy or publicity with regard to the unconditional right to use my name, voice, photographic likeness, video and biographical information and fishing tips and instructions in connection with any reproduction of same, videoaudio productions andor articles and press releases by FAN, and those acting under their permission, anywhere at any time, through any medium or media. I shall not be entitled to receive any royalties or other compensation in connection with such use. I further understand and agree that the tournament officials reserve the right to reject my application for any reason whatsoever.
The Participant(s) signifies by their signature below that they have read and understands the foregoing FAN provisions, rules, code of conduct, policies and procedures.
FAN Sexual Misconduct Policy
Faith Angler Network prohibits and does not tolerate sexual abuse or misconduct in the workplace or during any organization-related activity. Faith Angler Network provides procedures for employees, volunteers, board members or any other victims of sexual abuse or misconduct to report such acts. Those reasonably suspected or believed to have committed sexual abuse or misconduct will be appropriately disciplined, up to and including termination of employment or membership, as well as criminally prosecuted. No employee, volunteer, board member or other person, regardless of his or her title or position has the authority to commit or allow sexual abuse or misconduct.
Definitions and Examples
The following definitions or examples of sexual abuse, misconduct or harassment, may apply to any and/or all of the following persons – employees, volunteers or other third-parties.
Sexual abuse or misconduct may include, but is not limited to:
• Child sexual abuse – any sexual activity, involvement or attempt of sexual contact with a person who is a minor (under 18 years old) where consent is not or cannot be given.
• Sexual activity with another who is legally incompetent or otherwise unable to give consent.
• Physical assaults or violence, such as rape, sexual battery, abuse, molestation or any attempt to commit such acts.
• Unwanted and intentional physical conduct that is sexual in nature, such as touching, pinching, patting, brushing, massaging someone’s neck or shoulders and/or pulling against another’s body or clothes.
• Material such as pornographic or sexually explicit images, posters, calendars or objects.
• Unwelcome and inappropriate sexual activities, advances, comments, innuendoes, bullying, jokes, gestures, electronic communications or messages (e.g. email, text, social media, voicemail), exploitation, exposure, leering, stalking or invasion of sexual privacy.
• A sexually hostile environment characterized as comments or conduct that unreasonably interferes with one’s work performance or ability to do the job or creates an intimidating, hostile or offensive environment.
• Direct or implied threats that submission to sexual advances will be a condition of employment or affiliation with the organization.
Reporting Procedure
Immediately report suspected sexual abuse or misconduct to local authorities. It is not required to directly confront the person who is the source of the report, question or complaint before notifying any of the individuals listed. Faith Angler Network will take every reasonable measure to ensure that those named in complaint of misconduct or are too closely associated with those involved in the complaint, will not be part of the investigative team.
Anti-retaliation and False Allegations
Faith Angler Network prohibits retaliation made against any employee, volunteer, board member or other person who lodges a good faith complaint of sexual abuse or misconduct or who participates in any related investigation. Making knowingly false or malicious accusations of sexual abuse or misconduct can have serious consequences for those who are wrongly accused. Faith Angler Network prohibits making false or malicious sexual misconduct allegations, as well as deliberately providing false information during an investigation. Anyone who violates this rule is subject to disciplinary action, up to and including termination of employment or membership and criminal prosecution.
Investigation and Follow-up
Faith Angler Network will take all allegations of sexual abuse or misconduct seriously and will promptly, thoroughly and equitably investigate whether misconduct has taken place. The organization may utilize an outside third-party to conduct an investigation of misconduct. Faith Angler Network will cooperate fully with any investigation conducted by law enforcement or other regulatory/protective services agencies. Faith Angler Network will make every reasonable effort to keep the matters involved in the allegation as confidential as possible while still allowing for a prompt and thorough investigation.
Reporting to Law Enforcement or Appropriate Child or Adult Protective Services
Faith Angler Network is committed to following the state and federal legal requirements for reporting allegations or incidents of sexual abuse or misconduct to appropriate law enforcement and child or adult protective services organizations. It is the policy of Faith Angler Network to attempt to investigate or assess the validity or credibility of an allegation of sexual or physical abuse as a condition before reporting the allegation to proper law enforcement authorities or protective services organizations.
Employee and Worker Screening and Selection
As part of its sexual abuse and misconduct prevention program, Faith Angler Network is committed to maintaining a diligent screening program for prospective and existing employees, volunteers and others that may have interaction with those employed by, associating with or serviced by Faith Angler Network. The organization may utilize a variety of methods of screening and selection, including but not limited to applications, personal interviews, criminal background checks and personal and professional references.
Supervision of Youth
To provide a safe environment for minors, Faith Angler Network strives that a minimum of two adults supervise be in attendance with minors during organization-related activities. Or Two Students and on Adult. The purpose is to avoid one-on-one interactions between adults and minors that are not easily observable by others. If individual meetings with a minor must be held in an office, keep the door open. Only conduct closed door meetings when another adult is put on notice of the meeting and the door remains unlocked.
Acknowledgement Form: Sexual Abuse and Misconduct Prevention Policy
I acknowledge that I received and read the Sexual Abuse and Misconduct Prevention Policy and/or had it explained to me. I understand that it is my responsibility to abide by all rules contained in the policy. I also understand how to report incidents of sexual abuse or misconduct as set forth in the policy, including retaliation against any employee or volunteer exercising his or her rights under the policy.
I acknowledge that I will be alerted when changes and updates are made to the Sexual Abuse and Misconduct Policy and will be responsible for reading and complying with these updates.
FAN Misconduct Prevention Policy
Faith Angler Network and its Affiliates considers the safety and well being of the youth in our programs a top priority. We prohibit abuse and strive to proactively address reports of this type of conduct. We want to hear about problems or concerns and we will strive to act on them in a fair way in accordance with our policies. WE WILL REPORT SUSPECTED ABUSE TO THE PROPER LAW ENFORCEMENT AGENCIES.
Policy and Procedures
Faith Angler Network and its Affiliates has adopted the following Policy and Procedures in an effort to provide a safe environment for our coaches, athletes, and their families.
- Coach/Captain Recruitment
- Background Check- All current and potential coaches will be subject to a background check, including appropriate inquiries regarding any previous record of sexual abuse or other unlawful activity. This background check will be updated at least every one(1) year for each coach.
- Abuse Prevention Orientation - shall be conducted annually. A board member will review this policy with coaches, volunteers, and parents each year.
- Prohibited Behavior-
- The use of degrading language or behavior. Coaches/Captains are responsible for stopping disrespectful behavior between team members, including sexual harassment.
- Threatening or intentionally inflicting physical injury upon anyone especially a minor. Coaches are also responsible for stopping threatening behavior by players.
- Committing any sexual offense against a minor, or engaging in any sexual contact with a minor.
- Making any sexual advance, or engaging in other verbal, or physical conduct of a sexual nature with a minor.
- One-adult/one-child interaction except in an emergency where following this policy would be dangerous to the child. In an emergency situation, the coach or volunteer must contact a representative of the organization to inform him or her of this contact and the reason for it. If a child is receiving individual instruction or working with a private coach, this activity must be in a public setting rather than behind closed doors.
- Reporting of Suspected Child Sexual Abuse
- A member of Faith Angler Network and its Affiliates will be designated to receive reports of sexual abuse or other inappropriate conduct. This representative will promptly notify the proper law enforcement agencies.
- All coaches, volunteers, parents, and program participants are directed to report any incident of abuse or suspected abuse that they witness or that is reported to them to the designated (Name of Team) representative. Note: This does not preclude individuals from reporting abuse or suspected abuse to the proper law enforcement authorities.
- The designated representative will keep other board members fully informed.
- Should a suspected incidence of abuse be reported, the coach/volunteer in question may be temporarily suspended from duties while an investigation takes place.
All coaches and volunteers will be provided a copy of Sexual Abuse Prevention and Policy and Procedures and will be required to sign and date in order to start coaching or volunteering.
